Battery Regulation: Postponement of Due Diligence Obligations to 2027

Regulation (EU) 2025/1561: Postponement of the application of the Due Diligence obligation for batteries by two years. This decision by the European Parliament gives manufacturers and institutions more time to comply with the new rules.

On 18 July 2025, the European Parliament and the Council of the European Union adopted Regulation (EU) 2025/1561, amending Regulation (EU) 2023/1542 concerning batteries and waste batteries. The main change is the postponement by two years of the entry into force of the due diligence obligations for economic operators in the supply chain. The new application date, which was initially set for 18 August 2025, has been postponed to 18 August 2027.

This decision gives companies and institutions more time, and in particular, it allows:

  • economic operators to comply with their due diligence obligations with regard to critical raw materials such as cobalt, lithium, natural graphite and nickel by involving their supply chains;
  • Member States to complete the designation and accreditation process of notified bodies responsible for compliance checks;
  • the European Commission until 26 July 2026 to publish harmonised guidelines, aligning the new rules with those of Directive (EU) 2024/1760 on corporate due diligence.

The postponement aims to ensure that, at the time of entry into force, all actors in the supply chain have the necessary tools to effectively meet the required obligations.
