REACH: New Restrictions for CMR Substances and Exemption for Cumene in Aviation Fuels

Regulation (EU) 2025/1731 amends Annex XVII of REACH by adding new CMR substances to the list of restricted chemicals and introduces a specific exemption for cumene in aviation fuels

On August 8, 2025, the European Commission adopted Regulation (EU) 2025/1731, which amends Annex XVII of the REACH Regulation (EC No. 1907/2006) by introducing new substances classified as carcinogenic, mutagenic and/or toxic for reproduction (CMR) category 1A and 1B into Appendices 2, 4 and 6.

The newly listed substances will therefore be affected by restrictions 28, 29 and 30 of Annex XVII, which prohibit the placing on the market or use for sale to the general public of CMR substances of category 1A or 1B when the individual concentration in the substance or mixture is equal to or greater than:

  • the relevant specific concentration limit indicated in Annex VI, Part 3, of Regulation (EC) No. 1272/2008, or
  • the relevant generic concentration limit indicated in Annex I, Part 3, of Regulation (EC) No. 1272/2008.

Exemption for cumene in aviation fuels

The Regulation also introduces a specific exemption for cumene (CAS 98-82-8), already subject to restriction since December 1, 2023:

  • It is permitted in aviation fuels compliant with standards such as DEF STAN 91-091, ASTM D1655, JET-A, JET-A1, JP-x, DEF STAN 91-090, ASTM D910, and ASTM D7547.
  • The exemption is based on limited use by non-professional pilots and the absence of similar restrictions in Directive 98/70/EC for road fuels.

Entry into force

The regulation will be mandatory and directly applicable in all Member States starting from the twentieth day following its publication, with the new restrictions effective from September 1, 2025.
