Cypermethrin: European Commission Does Not Renew Approval for Product-Type 8
Draft Implementing Decision published on the non-renewal of cypermethrin as an active substance for wood preservatives (PT8) under Regulation (EU) No 528/2012
16 Feb 2026The European Commission has published the draft implementing decision providing for the non-renewal of the approval of cypermethrin as an active substance for use in biocidal products belonging to product-type 8 (PT8), concerning wood preservatives, pursuant to Regulation (EU) No 528/2012 (Biocidal Products Regulation – BPR).
Cypermethrin had been approved for PT8 under Commission Implementing Regulation (EU) No 945/2013, in compliance with the conditions laid down in the Annex to that act. The approval was initially set to expire on 31 May 2025.
On 24 November 2023, an application for the renewal of the approval was submitted in accordance with Article 13(1) of the BPR. Subsequently, by Implementing Decision (EU) 2025/362, the Commission extended the expiry date of the approval to 30 November 2027 in order to allow completion of the assessment of the application.
However, on 21 May 2025, the applicant formally withdrew the renewal application. In the absence of a positive assessment confirming compliance with the conditions set out in Article 4(1) of the BPR, the Commission considered it appropriate not to renew the approval of the active substance. Consequently, the draft legislative act repealing Implementing Decision (EU) 2025/362, which had postponed the expiry date of the approval of cypermethrin for PT8, has also been published.
The Commission has instituted a transitional phase to provide economic operators with sufficient time to comply with the updated regulatory framework. In particular:
- Treated articles treated with or intentionally incorporating cypermethrin for wood preservation purposes may be placed on the market for a period of 180 days from the entry into force of the decision;
- After that period, such treated articles may no longer be made available on the market.
The adoption of the measure is expected in May 2026.
The non-renewal of the approval of cypermethrin for product-type 8 entails significant impacts for biocidal product manufacturers, treated article producers, and the entire wood preservation supply chain. In this context, a thorough verification of regulatory compliance under the BPR and careful management of placing-on-the-market timelines become key elements in reducing the risk of non-compliance.
