Multilateral Agreement M372: ADR exemption for copper and copper-containing metal alloys
Germany becomes the second contracting country to sign the agreement
15 Jul 2026On July 3, 2026, the Ministry of Infrastructure and Transport (General Directorate for Motorization) submitted and forwarded to UNECE the Multilateral Agreement M372, requesting a derogation from the application of the ADR for the transport of copper and copper-containing metal alloys.
Specifically, the Agreement applies to the transport of:
- copper with a specific surface area > 0.67 mm²/mg, and
- metal alloys containing at least 2.5% copper, with a specific surface area greater than 0.67 mm²/mg.
According to the agreement, these metals, may be transported without being subject to other requirements of ADR Regulation, provided that the following conditions are met:
- they do not fulfill the criteria of any class other than Class 9;
- they are carried:
- in packagings, IBCs and large packagings that meet the general provisions of 4.1.1.1, 4.1.1.2 and 4.1.1.4 to 4.1.1.8 and are sift-proof and water-resistant or are fitted with a sift-proof and water-resistant liner; or
- in bulk according to VC1 or VC2 codes.
- a copy of this agreement will be carried on board the transport unit.
Therefore, in Italy and Germany, it is possible to use the multilateral agreement M372 for the transport of copper metal alloys assigned to the entry UN 3077 ENVIRONMENTALLY HAZARDOUS SUBSTANCE, SOLID, N.O.S., packing group III.
The agreement will remain valid until August 31, 2028, unless terminated earlier by the signatories.
