ECHA condivide la proposta di Restrizione per i composti del Cromo(VI)

Messa al bando di 13 composti del Cromo(VI) con alcune deroghe importanti

Dopo la richiesta da parte della Commissione Europea inviata il 29/09/2023 (e successivamente modificata il 29/04/2024 aggiungendo nuove sostanze al campo di applicazione), l'Agenzia Europea delle Sostanze Chimiche (ECHA) ha pubblicato la proposta per una restrizione riferita ai seguenti 13 composti del cromo esavalente:

In breve, ECHA propone la messa al bando dei 13 composti elencati, garantendo alcune esenzioni specifiche per i seguenti usi:

  1. Formulation of mixtures
  2. Electroplating on plastic substrate
  3. Electroplating on metal substrate
  4. Use of primers and other slurries
  5. Other surface treatment
  6. Functional additives/process aids

La documentazione prodotta da ECHA porta tre differenti proposte di restrizione per le stesse sostanze (RO1, RO2 e RO3), ma solo le prime due sono state considerate proporzionate ai rischi (la terza opzione non è quindi stata supportata).

Segue il testo delle due opzioni RO1 e RO2 a confronto:

  •  to formulate Cr(VI) containing mixtures within the meaning of Art. 3(2) of REACH,
  • in electroplating to deposit a chromium layer onto the surface of a metal substrate using an electrolytic solution,
  • in a mixture to coat objects with a paint or primer,
  • in other surface treatment processes that require no or low currents, including passivation, anodising, conversion coating, chromate rinsing, etching, pickling, stripping, deoxidising, desmutting, cleansing, sealing and insulation coating for the manufacture of grain-oriented electrical steel,
  • in the machining of articles that contain Cr(VI) in their coatings.

(ii) occupational exposures to Cr(VI) is below the limit value of 1 μg Cr(VI)/m3 (8h time-weighted average) for companies that use the substances: 

  • in electroplating to deposit a chromium layer onto the surface of a plastic substrate using an electrolytic solution,
  • as an alkali metal dispenser in the production of photocathodes,
  • as a corrosion or scaling inhibitor in cooling or heating systems for various applications,
  • as catalysts or processing aids in the electrolytic manufacture of different chemicals or ore processing applications,
  •  as a photosensitizer in UV lithography process to manufacture micro-structured components (filters, sieves, grids, etc.),
  • as a colour indicator in single-use chemical breathalysers,
  • in pyrotechnic compositions for the defence sector.

3. By way of derogation, where site-specific Cr(VI) releases are below the emission limit values of 0,25 kg/Cr(VI)/year to air and 1,5 kg Cr(VI)/year to water, paragraph 1 shall not apply under the following use conditions: (i) occupational exposures to Cr(VI) is below the limit value of 5 μg Cr(VI)/m3 (8h time-weighted average) for companies that use the substances: 

  • in the machining articles that contain Cr(VI) in their coatings. 

(ii) occupational exposures to Cr(VI) is below the limit value of 1 μg Cr(VI)/m3 (8h time-weighted average) for companies that use the substances: 

  • to formulate Cr(VI) containing mixtures within the meaning of Art. 3(2) of REACH,
  • in electroplating to deposit a chromium layer onto the surface of a metal substrate using an electrolytic solution. 

(iii) occupational exposures to Cr(VI) is below the limit value of 0,5 μg Cr(VI)/m3 (8h timeweighted average) for companies that use the substances: 

  • in electroplating to deposit a chromium layer onto the surface of a plastic substrate using an electrolytic solution,
  • in a mixture to coat objects with a paint or primer,
  • in other surface treatment processes that require no or low currents, including passivation, anodising, conversion coating, chromate rinsing, etching, pickling, stripping, deoxidising, desmutting, cleansing, sealing and insulation coating for the manufacture of grain-oriented electrical steel,
  • as an alkali metal dispenser in the production of photocathodes,
  • as a corrosion or scaling inhibitor in cooling or heating systems for various applications,
  •  as catalysts or processing aids in the electrolytic manufacture of different chemicals or ore processing applications,

4. Unless activities leading to Cr(VI) exposure are strictly segregated, a site operating in two or more of the use categories named in paragraph 3, points (i) and (ii), shall comply with the strictest relevant limit value.

Le proposte RO1 e RO2 sono quindi equivalenti nella struttura, tuttavia la RO2 pone dei limiti più stringenti.

Ecco alcune considerazioni sui paragrafi della proposta di restrizione:

  • La presentazione del campo di applicazione (sostanze coinvolte) mostra che anche gli usi di sali di Cr(VI) con una diversa stechiometria e grado di idratazione sono inclusi nella proposta di restrizione.
  • Il paragrafo 1 chiarisce che per rimanere al di fuori della restrizione le miscele devono contenere meno dello 0,01% della sostanza (valore inferiore al limite generico di classificazione per i cancerogeni o al limite oggi previsto per l’esenzione dall’applicazione dei requisiti di autorizzazione).
  • Il paragrafo 2 esclude dalla restrizione l’uso come intermedio (tale uso è anche attualmente esentato dagli obblighi di autorizzazione).
  • Il paragrafo 3 fornisce un elenco degli usi concessi, a patto di garantire il rispetto dei valori limite imposti per le emissioni in atmosfera, gli scarichi idrici e le concentrazioni in ambiente di lavoro. I valori proposti sono in alcuni casi sfidanti, con particolare riferimento alla RO2. Non basterà infatti rimanere al di sotto del VLEP fissato a 5 μg/m3. Le aziende dovranno quindi assicurarsi di utilizzare metodi di campionamento e analisi sufficientemente bassi per garantire il rispetto del limite. Gli usi non indicati si intendono non supportati.
  • Il paragrafo 4 chiarisce che, dove si svolgono più usi e quindi in teoria possono applicarsi diversi valori limite, il valore limite più stringente è rilevante a meno che l'utente possa dimostrare che i loro usi sono strettamente segregati.

Delle 13 sostanze indicate in restrizione, 12 sono attualmente elencate in allegato XIV (autorizzazione). Dovesse andare in porto, questa restrizione potrebbe sostituire i requisiti di autorizzazione attuali previsti dal regolamento REACH. La tredicesima sostanza, il cromato di bario, è stato incluso nell'ambito della restrizione per evitare sostituzioni indesiderate.

Non vi sono indicazioni particolari in merito alla transizione dall’attuale sistema a quello potenzialmente portato dalla proposta di restrizione, qualora si dovesse concludere positivamente l’iter. Nel dossier a supporto della proposta si specifica che “La formulazione giuridica definitiva (ossia l'iscrizione nell'allegato XVII del regolamento REACH), comprese le eventuali disposizioni pertinenti che disciplinano la transizione dagli obblighi previsti dal Titolo VII (autorizzazione) agli obblighi previsti dalla restrizione proposta, è decisa dalla Commissione europea durante la fase decisionale.

Prossimi step

Dopo la pubblicazione della proposta, tutti gli stakeholder avranno l'opportunità di fornire informazioni supportate da prove solide durante una consultazione di sei mesi, che dovrebbe iniziare il 18 giugno 2025. A tal proposito, ECHA sta pianificando di organizzare una sessione informativa online per spiegare il processo di restrizione e aiutare gli stakeholder a partecipare alla consultazione.

Successivamente alla consultazione i Comitati scientifici RAC e SEAC di ECHA valuteranno la proposta di restrizione. Nella loro valutazione, considereranno le prove scientifiche ricevute durante le consultazioni. La Commissione Europea, insieme agli Stati membri dell'UE, prenderà la decisione sulla restrizione e le sue condizioni, basandosi sulla proposta dell'ECHA e sull'opinione dei comitati.

Conclusione

La proposta di restrizione ha sicuramente un impatto importante per le aziende che impiegano questi 13 composti del cromo esavalente. Considerando quanto sopra, serve tuttavia ancora tempo per capire come evolverà la situazione, intanto le aziende possono prendere visione della proposta di restrizione e iniziare a valutare l’applicabilità della stessa e l’adeguatezza dei metodi di misura delle emissioni e dell’esposizione dei lavoratori oggi impiegati.
